The reinstated Deputy Governor of Edo State Philip Shaibu has shoved the appeal accompanied by a request for a stay of execution swiftly filed by the House of Assembly against the court judgement reinstating him.
Penpushing reports that Shaibu declared that he remains the Deputy Governor of in the aftermath of Wednesday’s court judgement reinstating him after his removal by the State House of Assembly in April, 2024.
The Deputy Governor who displayed a copy of the court judgement explained that based on legal procedure, he still holds the Edo State Deputy Governor’s position until the court issues explicitly an order to stay the execution of the judgement.
Penpushing further reports Shaibu who is excited with the judgement in his favour emphasized that a court of law does not stop executing a declarative judgement like the one he obtained adding that merely filing an appeal and applying for a stay of execution of a judgement does not automatically operate as an order of stay of execution.
“This is the judgement of the court. A declarative judgement of the court. And a declarative judgement, if you follow the law, the Supreme Court law, you cannot stay a declarative judgement. A motion or application. Does it act like stay? You are telling me I want to do X, and I have not granted it; it cannot act as stay.”
Penpushing also reports that Shaibu who was removed by Edo State House of Assembly on April 8, 2024 over allegations of gross misconduct claimed to have resumed duty and equally wrote to the government to reinstate all his political appointees.
The Governor, Godwin Obaseki, it is recalled on removal of Shaibu immediately nominated Omobayo Godwin as replacement, and was confirmed by the assembly while the Governor promptly swore him in as the Deputy Governor the same day.
Penpushing reports that the Federal High Court in Abuja, however, upheld on Wednesday Shaibu’s suit challenging his removal from office, holding that the allegations over which the House of Assembly removed him did not constitute acts of gross misconduct.
The judge, Justice James Omotosho, nullified Shaibu’s removal and ordered his reinstatement to office, as well as ruling that the payment of salaries and entitlements since the House of Assembly illegally removed him from office in April must be paid.
