The Independent National Electoral Commission (INEC) and All Progressives Congress (APC) have asked the Presidential Election Petition Court in Abuja to dismiss Peter Obi’s petition challenging Bola Tinubu’s victory.

Penpushing reports that Obi, who was the presidential candidate of the Labour Party (LP), came third in the 25 February presidential election, and has approached the tribunal alongside his party to challenge victory of Bola Tinubu of the All Progressives Congress (APC) as President-Elect

The Labour Party (LP) Presidential Candidate and his party accused the electoral commission and All Progressives Congress (APC) of manipulating election results in favour of Tinubu, and equally contending Tinubu’s failure to secure 25 per cent of lawful votes cast in the Federal Capital Territory (FCT).

Penpushing further reports that the Independent National Electoral Commission (INEC), while faulting Obi’s claims argued that it conducted the polls in strict compliance with the constitution and electoral laws, and thereby challenge him and his party to prove the contrary.

The All Progressives Congress (APC) while challenging the competence of the petition, Thomas Ojo, a member of the ruling party legal team led by, a Senior Advocate of Nigeria (SAN), Lateef Fagbemi, argued that Obi was not a genuine member of the Labour Party (LP) as at the time of the election.

Penpushing also reports that All Progressives Congress(APC) contended that  Obi was a member of the Peoples Democratic Party(PDP) as of 24 May 2022, during which the party screened him as one of its presidential aspirants in April 2022, arguing that Obi’s nomination as Labour Party (LP’s) Presidential candidate breached Section 77(3) of the Electoral Act.

The All Progressives Congress( APC argued that Section 77(3) of the Electoral Act mandates a political party to submit its membership register to the electoral umpire 30 days before their presidential primary election.
