Appeal court sacks senator Abbo of Adamawa state

The Court of Appeal sitting in Abuja, on Monday, sacked the All-Progressives Congress (APC) Senator Elisha Abbo representing Adamawa North Senatorial District, and ordered the Independent National Electoral Commission (INEC) to issue a Certificate of Return to Amos Yohanna of the Peoples Democratic Party (PDP) as the validly elected lawmaker for the senatorial district.

Penpushing reports that the Independent National Electoral Commission (INEC) had, on 25 February, 2023 confirmed Abbo as the winner of the senatorial poll, but the victory was challenged by Yohana and the Peoples Democratic Party (PDP)

The challengers took their petition before the National and State Houses of Assembly Election Tribunal sitting in Yola, Adamawa State, a case which was heard by a three-member panel of the court presided over by Justice C.E. Nwosu-Iheme.

The tribunal it is recalled, in its judgment, dismissed Yohanna’s petition for lack of merit, but further dissatisfied by the judgement, Yohana who is a Pastor and Peoples Democratic Party (PDP) candidate headed to the appeal court.

Penpushing further reports that Yohana through his counsel Johnson Usman (SAN) approached the Appeal Court via appeal number: CA/YL/EP/AD/SEN/06/2023 between Amos Kumai Yohanna and Ishaku Elisha Cliff and others.

The Court of Appeal, after hearing arguments from parties, agreed with Usman that based on Section 137 of the Electoral Act, 2022, the results tendered clearly showed that there was no compliance with the Electoral Act.

Penpushing also reports that the court, thereafter, deducted the invalid votes from the parties and found that Yohanna and Peoples Democratic Party (PDP) won the election by majority of lawful votes, and set aside the Certificate of Return issued to Abbo and ordered the electoral commission to issue the same to Yohanna as the valid winner of the election.
