The Court of Appeal in Ibadan has affirmed the selection and installation of Ghandi Olaoye as the traditional ruler of Ogbomoso town in Oyo State, a selection which had earlier been nullified by a High Court.

Penpushing reports that a three-member panel of justices, led by Justice Yargata Nimpar in the judgment delivered on Tuesday declared that the lower court had no jurisdiction to entertain the case and therefore ruled in favour of Olaoye

The panel added that the respondents failed to comply with the administrative procedure of writing the government about their dissatisfaction with the selection before approaching the court, and thereby set aside the lower court’s judgment and affirmed the selection and installation of Olaoye as the Soun of Ogbomoso.

Penpushing further reports that, the respondents’ lead counsel, Abiodun Ogunjumi, during an interview with journalists said his client was dissatisfied with the judgment of the Court of Appeal, and was, however, ready to file notice and grounds of the appeal to challenge the judgment of the Court of Appeal at the Supreme Court.

The Oyo State High Court in Ogbomoso it is recalled had, on October 25, 2023, nullified the selection and installation of Olaoye as the Soun of Ogbomoso, asserting that Olaoye’s nomination was irregular, null and void.

Penpushing also reports that the judge Justice K. A. Adedokun of the High Court emphasized that the process did not comply with the provisions of the Soun Chieftaincy Declaration of 1958.
