The Court of Appeal sitting in Asaba, Delta State has upheld the judgment of a lower court banning the Federal Road Safety Commission (FRSC) from operating on state and local roads in the country, just as the commission raised concern on the judgement that with the development its officials would not be able to attend to or rescue crash victims on roads other than federal roads.
Penpushing reports that it is recalled that a Federal High Court had earlier in 2019, held that the commission has no legal right to operate or carry out any activity on roads belonging to states and local government areas.
The trial judge had in its judgment restrained the Federal Road Safety Corps(FRSC) from operating on roads other than federal highways and also awarded a cost of N10 million against the commission, but the commission dissatisfied with the judgment challenged the high court’s decision at the Court of Appeal
Penpushing further reports that the judge, Justice E. Nwite ruling on the matter on Monday dismissed the commission’s appeal and upheld the trial court decision, and therefore restricts the commission to only federal roads in different parts of the country
The Corps Marshall of the Federal Road Safety Corps(FRSC), Dauda Biu, while reacting said the commission would appeal the judgment of the Appeal Court, adding that the commission was seeking a stay of execution of the appellate court judgment.
Penpushing also reports that Biu said the commission has been briefed on the court judgment but was yet to get a copy of it, stressing that as soon as it is gotten the commission would take time to study the judgement
